1. Agreement to Terms
By accessing or using ScentBuddy at scentbuddy.io (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Use of the Service
Eligibility
You must be at least 13 years of age to use ScentBuddy. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.
Acceptable Use
You agree not to use the Service to:
- Upload harmful, offensive, or illegal content
- Impersonate any person or entity
- Spam other users or abuse community features
- Attempt to gain unauthorised access to any part of the Service
- Use automated tools to scrape or extract data from the Service
- Violate any applicable laws or regulations
3. User Content
Your Content
You retain ownership of content you submit to ScentBuddy, including fragrance reviews, personal notes, and profile information ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your User Content solely for the purpose of operating and improving the Service.
Community Content
Certain content — such as your wear diary entries and community activity — may be visible to other users. You are responsible for the content you choose to share publicly.
Content Standards
User Content must not be defamatory, obscene, hateful, or otherwise objectionable. We reserve the right to remove any content that violates these standards at our sole discretion.
4. AI Features
ScentBuddy uses artificial intelligence to provide personalised fragrance recommendations and other features. These recommendations are generated algorithmically based on your collection data and preferences. AI-generated suggestions are for informational and entertainment purposes only. We do not guarantee the accuracy or suitability of any recommendation.
5. Intellectual Property
The Service, including its design, code, logo, and content created by ScentBuddy, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our proprietary content without our express written permission.
Fragrance names, brand names, and related trademarks mentioned on the Service are the property of their respective owners. ScentBuddy is not affiliated with, endorsed by, or sponsored by any fragrance brand.
6. Free Service and Premium Features
ScentBuddy currently offers its core features free of charge. We reserve the right to introduce paid features or subscription plans in the future. If we do, we will provide clear advance notice. Existing free features will remain available to existing users during any transition period.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that fragrance information displayed on the Service is accurate, complete, or current.
8. Limitation of Liability
To the maximum extent permitted by applicable law, ScentBuddy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or €50, whichever is greater.
9. Third-Party Links and Services
The Service may contain links to third-party websites, services, or content. These links are provided for convenience only. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
10. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
You may delete your account at any time from the Account settings page. Upon deletion, your personal data will be removed from our systems within 30 days, except where we are required to retain it by law.
11. Changes to Terms
We may revise these Terms from time to time. The most current version will always be at scentbuddy.io/terms. If a revision is material, we will provide at least 14 days' notice before the new terms take effect. By continuing to use the Service after revisions become effective, you agree to the revised Terms.
